113 Non-Citizens Voted in D.C. 2024 Presidential Primary, Judicial Watch Finds

Judicial Watch announced today that it received an Excel spreadsheet from the District of Columbia Board of Elections revealing that 113 non-citizens voted in the June 2024 Presidential Primary. This information was obtained through a D.C. Freedom of Information Act (FOIA) request submitted by Judicial Watch on July 3, 2024.

FOIA Request Details

The FOIA request sought:

  • Public records identifying the number of non-citizens who voted in the June 2024 primary
  • The wards in which they are located
  • The party affiliation they registered as
  • Records indicating whether the non-citizens are lawfully or unlawfully present aliens
  • Records identifying the same information for non-citizens registered to vote who will be eligible to vote in the general election, including independents

This spreadsheet updates data previously received by Judicial Watch from a pre-primary D.C. FOIA request (May 14, 2024). The earlier data revealed that 583 foreign nationals were registered to vote in the June primary election. Additionally, these records confirmed that non-citizens could serve as election workers in the District of Columbia.

Based on the updated, post-primary data, and information from the D.C. Board of Elections website, the turnout rate in the primary among non-U.S. citizen registrants was 19.3%, compared to a 25.9% turnout rate among U.S. citizen registrants.

Records previously obtained by Judicial Watch include a Board of Elections meeting transcript explaining that non-citizens are not required to have an ID to vote. If they lack proof of residence when registering to vote or voting for the first time, they can vote by “Special Ballot.” Additionally, a “Voting Guide for Incarcerated Residents” indicates that prisoners are allowed to vote.

Judicial Watch President Tom Fitton stated, “The fact that 113 foreign nationals voted in the presidential primary in Washington, D.C., is a national scandal, is an insult to every American voter, and may be a violation of federal law.”

While federal law prohibits non-citizens from voting in federal elections, some states and local jurisdictions allow non-citizens who are legal permanent residents to vote in local elections. These include:

  • Garrett Park
  • Glen Echo
  • Hyattsville
  • Martin’s Additions
  • Mount Rainier
  • Riverdale Park
  • Somerset
  • Takoma Park

Vermont:

  • Burlington
  • Montpelier
  • Winooski

In May 2024, Judicial Watch received records from the District of Columbia explaining how illegal aliens and other non-citizens can register to vote in local elections.
